Workers’ Compensation – Maine

In the state of Maine, the Workers Compensation program is administered by the Department of Professional and Financial Regulation’s Bureau of Insurance. Unlike many states, Maine provides an exemption for employers who hire what is termed as “casual” or “seasonal” workers. However, even though these employers receive exemption from participation in Workers’ Comp.. employers must comply with other State Liability laws.

The state of Maine requires the employer to file claims for all injuries of employees which are job-related. This must be done within fourteen days after the reported injury. With the exception of immediate Medical treatment, the injured employee is subject to a waiting period of seven days before additional benefits are paid by the state. Should the injured employed not be able to return to work for more than fourteen days, the employer is required to pay lost wages including the seven day waiting period.

There are severe consequences involved should employers disregard the laws of Maine pertaining to Workers’ Compensation in the state of Maine. The state can impose fines equal to one hundred and eight percent of the premiums the employer would have paid for coverage or ten thousand dollars whichever is more. If the state chooses to do so, it may suspend any licensing held by the company to operate in the state of Maine. In addition, the General liability carrier of the company will not defend or compensate the company in its litigation with the state.

Workers’ Compensation benefits in Maine also include compensation for travel expenses incurred by the injured employee in traveling to and from their Medical treatment provider. The only stipulation is the treatment must pertain directly to the injury. The rate per mile the state provides is fifty cents. In order for the worker to receive this benefit, they must submit a request form in writing to the employer.

Employers in Maine understand the importance of carrying the necessary coverage required by Workers’ Compensation. They understand the consequences should they not comply with the law of the state of Maine. It is also important they realize if there seems to be an unusual amount of claims, there has to be an issue which needs to be addressed. Accidents can happen and do from time to time. This can be the case with any employer. Sometimes regardless of how cautious the employer happens to be, the unforeseen can occur. It is when it happens continually, steps need to be taken.
